My insurance company has not approved my surgery . . . the surgery that I am supposed to have one week from today. I am waiting to hear back – supposedly this afternoon – about it. I was told this morning that they will not approve it if they have a “competent” surgeon within the network  . . . and, it is their belief that my surgeon . . . the one who over-expanded me and caused permanent damage . . . is “competent”. They believe I should stay with her . . . can you believe this? I can not.
I told them that I will not, under any circumstance, go back to Dr. Z. No way! But, it is not up to me whether they authorize the surgery with Dr. Sherman. Welcome to healthcare, USA style.

Do you think if Dr. Z has a lawsuit for malpractice pending, she’ll maintain her status as “competent”? I’m sure we can get something filed within 48 hours. I’m just sayin’!

🙂 I hear you, but . . . not only do I not want a law suit . . . did you know that to file a medical malpractice case in California that you actually have to get permission to do so? Here’s how it works, in order to file a suit for med mal you have to find a doctor who will find, in advance of your filing suit, that you have a medical malpractice case. It is crazy, it is the only area of law – that I know of, anyway – where you have to have an expert witness’s would be testimony as part of your complaint. Can you believe that? I probably have a detail or two off, but, the gist of it is that you have to get a doctor who is a) willing to testify against your doc and b) has the time to review all of your medical records first and c) put together their own case as to why/how you have been wronged. It is pretty slanted in their favor.
Besides, I really don’t want to go that route, I just want to have good medical care. I want Dr. Sherman as my surgeon. I hope it works out. I am supposed to hear something more this afternoon. Wish me luck and say some prayers, if you would 🙂
